Welcome to Canary. By downloading, accessing, or using the Canary application and related services ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Service.
Service Description
Canary is a personal safety application that allows users to designate trusted contacts who may receive SMS alerts in the event of an emergency or a missed safety check-in. Messages are sent only when triggered by user activity and are intended solely to notify selected contacts so they can check on the user's safety. The Service is not intended for promotional, marketing, or commercial messaging of any kind.
SMS Messaging
Canary sends SMS messages to user-designated trusted contacts as part of its core safety functionality. By using the Service or being designated as a trusted contact, you acknowledge and agree to the following:
Messages are transactional and safety-related only — not promotional or marketing in nature
Messages are triggered solely by user activity (e.g., a manually triggered emergency alert or a missed safety check-in)
When first added as a trusted contact, recipients will receive a one-time introductory SMS explaining the nature of Canary alerts and how to opt out
Message frequency varies based on user activity and is not fixed or scheduled
Message and data rates may apply depending on your carrier plan
To stop receiving messages at any time, reply STOP
For help, reply HELP
Canary does not share, sell, rent, or disclose mobile phone numbers — yours or those of your designated contacts — to any third party for marketing or any other commercial purpose.
User Responsibilities
By using the Service, you agree to:
Only designate individuals as trusted contacts who have explicitly agreed to receive SMS safety alerts from Canary on your behalf
Confirm each contact's consent within the app before adding them, as prompted during setup
Use the Service solely for personal safety purposes
Not use the Service to harass, spam, or send unsolicited messages to any individual
Canary reserves the right to suspend or terminate accounts that violate these responsibilities.
Trusted Contact Consent and Opt-In
During app setup, users are required to confirm that each designated contact has agreed to receive SMS safety alerts before that contact is added. Upon being added, trusted contacts receive an introductory message explaining the Canary service and providing opt-out instructions.
By being designated as a trusted contact, the recipient acknowledges that they have consented to receive SMS messages related to the user's safety status. Consent may be withdrawn at any time by replying STOP to any message.
Opt-Out Instructions
To stop receiving SMS messages from Canary at any time, reply:
STOP
You will receive a confirmation message and will not receive further messages unless re-added by a user and you choose to re-subscribe by replying START.

Limitation of Liability
The Service is provided "as is" without warranties of any kind, express or implied. Canary is not responsible for:
Delayed, undelivered, or misdirected messages due to carrier issues or network conditions
Actions taken or not taken by recipients of safety alerts
Any damages, direct or indirect, resulting from use of or inability to use the Service
Any reliance placed on the Service as a sole means of emergency response
Users are encouraged to maintain additional emergency contacts and utilize official emergency services (911) when appropriate.
Modifications
We may update these Terms and Conditions at any time. Updates will be posted on this page with a revised effective date. Continued use of the Service following any update constitutes acceptance of the revised Terms.
